President Obama took a back door approach to amnesty by executive fiat — a total subversion of the U.S. Constitution.

The U.S. Senate voted down the Dream Act in December 2010. Obama pushed the law through on Friday, June 17, by executive order, bypassing Congress to get amnesty for illegals. The Obama administration issued a memo announcing that federal immigration officials do not have to deport illegal aliens if they are enrolled in any type of education program, if their family members have volunteered for the U.S. military service, or even if they are pregnant or nursing.

This new policy was quietly announced and completely ignored by the mainstream press. Kansas’ Secretary of State and co-author of Arizona’s SB1070 immigration law, Kris Kobach, told the Daily Caller: “They’re pushing the immigration agents to be even more lax, to go further in not enforcing the law. At a time when millions of Americans are unemployed and looking for work, this is more bad news coming from the Obama administration. If this administration really cared about putting Americans back to work, it would be vigorously enforcing the law.”

A new memo penned by Immigration and Customs Enforcement (ICE) Agency Director John Morton directs ICE agents, attorneys and directors to exercise “prosecutorial discretion” — meaning less likelihood of deportation — for illegal aliens who have been students in the U.S., who have been in the country since childhood, or who have served in the military.

Syndicated columnist Charles Krauthamer calls this maneuver a constitutional breach, pointing out that it is Congress’ responsibility to enact laws: “This is outright lawlessness on the part of the administration,” argued Krauthamer. “Whatever the politics of this, we do have a Constitution. And under it, the Legislature, the Congress, enacts the laws and the executive executes them. It doesn’t make them up. The Dream Act was rejected by Congress in December. It is now being enacted by the executive, despite the express will of the Congress.”

This bold and arrogant administration is going against the will of the people. The health-care law that the people didn’t want, then Libya, and now this. What’s next? Obama and his administration are completely out of touch with the American people.
