LOWELL -- A 48-year-old city man was released on bail after he was accused throwing a electric saw at his brother-in-law and then hitting him in the face with an aluminum baseball bat in a dispute over being fired.

Armando O. Luna, of 193 Hildreth St., was released on $500 cash bail after pleading not guilty in Lowell District Court to assault and battery with a dangerous weapon, assault with a dangerous weapon, and assault and battery.

Lowell police allege in court documents that at 6 p.m. on Feb. 18 police responded to 56 Ellis Ave. for a report of a man struck with a baseball bat by his brother-in-law. The suspect had fled the scene in a Honda Civic.

The 32-year-old victim had a large amount of swelling on the left side of his face and a gash on the bridge of his nose.The victim told police he arrived home from the store to find Luna was sitting in his car at the end of the driveway.

Luna allegedly got out of his car carrying the saw and started arguing with the victim about getting his paycheck. The two men worked for the same company, but Luna had been fired by the victim -- his brother-in-law -- four days earlier.

Luna allegedly still had some company tools. When Luna saw the victim, he threw the saw at him, just missing his chest because the victim moved out of the way. Luna allegedly then pushed the victim and punched him, before going back to his car to retrieved an aluminum baseball bat.

Luna then allegedly hit the victim twice in the head with the baseball bat, yelling, "Now I'm going to show you who I am.



The incident was witnessed by Luna's sister, the victim's wife, who told police her brother called her home five times requesting his paycheck and was upset because his former employer gave Luna a bad recommendation for a job he was seeking. She made arrangements to have her brother stop by their mother's house to pick up a check and return the tools. Instead, he drove to her house.

His next court date is March 25 for a probable cause hearing.
