LOWELL -- The attorney representing a Westford woman charged with assaulting her grandson's father, who is a Billerica police officer, said prosecutors have told him there was "nothing negative'' in the files regarding Officer Scott Peloquin.
Defense attorney Raymond Weicker, who represents Janet L. Gavin, filed a motion in October asking Billerica police for any internal-affairs reports about Peloquin.
Weicker's motion asked that he be provided with documents of any internal affairs reports probing whether Peloquin lied during investigations when he worked at the Westford and Lawrence police departments.
But in Lowell District Court on Monday, Weicker tells The Sun , the Middlesex District Attorney's Office informed him that the only investigation of Peloquin involved his home being robbed.
Billerica Police Chief Daniel Rosa said he can't comment on personnel issues, but "in this particular case all indications are that Scott Peloquin was the victim of an assault.''
Gavin, 58, of 29 South Chelmsford Road, was charged with assault and battery with a dangerous weapon (cellphone) and intimidation of witness (trying to prevent a call to police) stemming from an Aug. 24 incident where she allegedly hit Peloquin in the head with cell phone during a custody exchange of Peloquin's son.
Her next court date is Jan. 27 for a status hearing.
